Student Waiver & Release of Liability

RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS AND INDEMNITY AGREEMENT.

(hereinafter the “Release Agreement”)

BY SIGNING THIS RELEASE AGREEMENT, YOU WILL WAIVE OR GIVE UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE FOR NEGLIGENCE, BREACH OF CONTRACT OR BREACH OF THE OCCUPIERS LIABILITY ACT OR CLAIM COMPENSATION FOLLOWING AN ACCIDENT. PLEASE READ CAREFULLY.

I have received or will obtain a copy of Flipside Gymnastics Ltd. policies and will take the responsibility to carefully read and follow the rules and policies therein. I understand that Flipside Gymnastics Ltd. does not give credit and/or refunds for class(es) missed due to holiday, vacation, illness, weather, etc. I further understand that there are specific risks of physical or property damages, losses, or injury that may result from my or my child’s participation with Flipside Gymnastics Ltd., and I voluntarily assume the risks associated with such participation.  Flipside Gymnastics Ltd. and their respective directors, officers, employees, members, participants, coaches, volunteers, agents, independent contractors, subcontractors, representatives, successors, and all owners, operators or occupiers of the facilities in which the gymnastics activities, as defined below, take place (all of whom are hereinafter collectively referred to as the “Releasees"). 

In this Release Agreement, the term "gymnastics activities" shall include all orientation, training, instruction, supervision, competitions, programs, services, and use of facilities and equipment which are organized, provided, controlled or conducted by the Releasees. 

ADULT and MINOR/COMPANION RELEASE AND INDEMNITY

PLEASE READ CAREFULLY

RE: Use of Premises and Equipment of “Flipside Gymnastics Ltd.” (hereafter referred to as "Flipside") 

TO: “Flipside Gymnastics Ltd.”, operating as “Flipside Gymnastics” (referred to in this document as “Flipside”) and its directors, officers, employees, representatives, officials, landlord and agents (collectively referred to in this document as the "Agents")

I have read the guidelines and rules issued for the use of “Flipside” premises and equipment, which I understand, and I agree to be bound by them. In consideration of your acceptance of my being permitted to use the premises and equipment and/or any activity associated therewith, I agree to RELEASE, SAVE HARMLESS AND INDEMNIFY “Flipside” and/or its agents from and against all claims, actions, costs and expenses and demands in respect to death, injury, loss or damage to my person or property wheresoever and howsoever caused, arising out of, or in connection with my use of the premises and equipment notwithstanding that the same may have been contributed to or occasioned by any act or failure to act, including, without limitation, negligence, of “Flipside” and or anyone or more of its agents. I further agree and acknowledge that:

  1. The rules and guidelines governing the use of the premises and equipment are solely for that purpose and it remains my sole responsibility to act and govern myself in such a manner as to be responsible for my own safety;
  2. I am aware of the risks inherent in participating in gymnastics activities and the use of gymnastics premises, facilities and equipment and I assume the risks and waive notice of all conditions, dangers or otherwise relating to or arising out of such use.
  3. Where applicable and if so required or participating in, I am aware of the risks inherent in helping my child with gymnastics activities and the use of gymnastics premises, facilities and equipment and I assume the risks and waive notice of all conditions, dangers or otherwise relating to or arising out of such use. I am aware that I am not participating in any gymnastics activity but rather helping my child with his/her gymnastics activity.

I further agree to HOLD HARMLESS AND INDEMNIFY “Flipside” and its agents from any and all actions, claims, demands, losses, judgments or costs of any nature to any third party resulting from my use of the premises and equipment herein and I agree not to make any claims or take any proceedings against any other person, society, corporation or other legal entity who might claim contribution or indemnity from “Flipside” and/or its agents in respect of matters which are the subject of this Release. Exposure to infectious disease including COVID-19 is one of the risks of participating in gymnastics activities.  Specific information regarding the response of Flipside to the COVID-19 pandemic can be found on the company website for member, parent and/or guardian review. If you are a parent or guardian of a participant under the age of 19, please educate your child on these risks and protocols before/after completing this form. I agree that this Release shall bind my heirs, executors, administrators and assigns. I confirm that I am the full age of nineteen (19) years or older and I have read this Release and understand it.

I AM AWARE OF THE RISKS, DANGERS AND HAZARDS ASSOCIATED WITH GYMNASTIC ACTIVITIES AND I FREELY ACCEPT AND FULLY ASSUME ALL SUCH RISKS, DANGERS AND HAZARDS AND THE POSSIBILITY OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE OR LOSS RESULTING THEREFROM.

RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT (applies to person 19 years of age and older) In consideration of THE RELEASEES allowing me to participate in gymnastics activities, I hereby agree as follows: 

1. TO WAIVE ANY AND ALL CLAIMS that I have or may in the future have against THE RELEASEES and TO RELEASE THE RELEASEES from any and all liability for any loss, damage, expense or injury including death that I may suffer or that my next of kin may suffer as a result of my participation in gymnastics activities, DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, INCLUDING ANY DUTY OF CARE OWED UNDER THE OCCUPIERS LIABILITY ACT, R.S.B.C. 1996, c. 337, ON THE PART OF THE RELEASEES. I UNDERSTAND THAT NEGLIGENCE INCLUDES FAILURE ON THE PART OF THE RELEASEES TO TAKE REASONABLE STEPS TO SAFEGUARD OR PROTECT ME FROM OR WARN ME OF THE RISKS, DANGERS AND HAZARDS OF PARTICIPATING IN GYMNASTICS ACTIVITIES;

2. TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all liability for any property damage or personal injury to any third party resulting from my participation in gymnastics activities;

3. This Release Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives, in the event of my death or incapacity;

4. This Release Agreement and any rights, duties and obligations as between the parties to this Release Agreement shall be governed by and interpreted solely in accordance with the laws of British Columbia and no other jurisdiction; and

5. Any litigation involving the parties to this Release Agreement shall be brought solely within British Columbia and shall be within the exclusive jurisdiction of the Courts of British Columbia.

In entering into this Release Agreement I am not relying on any oral or written representations or statements made by the Releasees with respect to the safety of gymnastics activities, other than what is set forth in this Release Agreement. 


I CONFIRM THAT I HAVE READ AND UNDERSTAND THIS RELEASE AGREEMENT AND I AM AWARE THAT BY SIGNING THIS RELEASE AGREEMENT I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS, ASSIGNS AND REPRESENTATIVES MAY HAVE AGAINST THE RELEASEES.

Safety and Conduct

POTENTIAL RISKS

There are many potential risks when individuals participate in gymnastic activities (including but not limited to Men’s and Women’s Artistic, Trampoline, Acrobatic, Parkour, and other Gymnastics for All activities). Participants in gymnastic activities acknowledge they are aware of; and may be exposed to, the risks, dangers and hazards of gymnastic activities. The risks, dangers and hazards include, but are not limited to:

  • Executing strenuous and demanding physical techniques and exerting and stretching various muscle groups.
  • Vigorous physical exertion, strenuous cardiovascular workouts, and rapid movements.
  • The failure to properly use any piece of equipment or from the mechanical failure of any piece of equipment or apparatus.
  • Failure to follow instructions or rules.
  • Spinal cord injuries which may render the Participant permanently paralyzed.
  • Serious injury to virtually all bones, joints, ligaments, muscles, tendons, and other aspects of the Participant’s body or to the Participant’s general health and well-being.
  • Abrasions, sprains, strains, fractures, or dislocations.
  • Concussion or other head injuries, including but not limited to, closed head injury or blunt head trauma.
  • Physical contact with other participants, spotters, spectators, equipment, and hazards.
  • Collisions with walls, any gymnastics apparatus, floors, or mats.
  • Falling, tumbling, or hitting any gymnastics apparatus, the floor, mats, or other surfaces.
  • Not wearing appropriate attire or personal equipment (e.g., grips).
  • Failure to act safely or within the Participant’s ability or designated areas
  • Contracting COVID-19 or any other contagious disease.
  • Privacy breaches, hacking, technology malfunction or damage.
  • Negligence of other persons, including other spectators, participants, or employees; and
  • Travel to and from competitive events and associated non-competitive events which are an integral part of the Activities
GYM SAFETY & CODE of CONDUCT
  1. All participants must sign the Release Of Liability, Waiver Of Claims, Assumption Of Risks And Indemnity Agreement before starting any activities at Flipside Gymnastics.
  2. This gymnastics facility may have uneven floor surfaces covered with mats and equipment. Watch where you walk.
  3. Observe and obey all posted signs and warnings.
  4. Follow the instructions of your coach and/or other Flipside Gymnastics staff members if required.
  5. Before attempting a new skill or progression, ask your coach.
  6. If you are using a trampoline, there must be spotters around the trampoline.
  7. Always use the equipment as it was intended.
  8. You must have sufficient physical dexterity, ability, and knowledge to safely engage in gymnastics activities. If in doubt, ask your coach.

Examples of places that don't require proof of vaccination

You don't have to show proof of vaccination at places like:

  • Grocery stores, liquor stores and pharmacies
  • Unlicensed restaurants that don't offer table service, like fast food, coffee shops and takeout
  • Local public transportation (BC Transit, TransLink, BC Ferries)
  • Salons, hairdressers, barbers
  • Hotels, resorts, pools, cabins and campsites
    • Unless it is a setting or event covered by the PHO order. For example a licensed hotel restaurant, wedding reception or conference
  • Banks and credit unions
  • Retail and clothing stores
  • Public libraries 
  • Food banks and shelters
  • Escape rooms, laser tag, indoor paint ball, arcades and bowling alleys (if they are unlicensed or don't offer table service)
  • Post-secondary on-campus cafeterias

You don't have to show proof of vaccination at events like:

  • Worship services
  • Indoor youth recreational sport for people 19 years old or younger
  • Before and after school programs for K to 12 students
  • Student events and activities in K to 12 public and independent schools
  • Indoor organized events with less than 50 people, except adult sports

Philosophy - Recreation programs are designed first and foremost to be fun. They also provide superior physical development (flexibility and strength), challenging activity and a measure of success and accomplishment for the child.

Structure - Our 14 color/level ‘CanGym’ program has been modeled after the Gymnastics
Canada Gymnastique (GCG) 'CanGprogram
. Instruction is provided on all Olympic gymnastics events plus trampoline. Each class is streamed according to age, award level and/or previous experience. Boys and Girls are coached in separate groups. There is a maximum student to instructor ratio of 8 to 1.  (Please ensure your child attends in proper attire and with long hair pulled back)

Accomplishment - Progress reports are provided to students upon fitness assessments dates, followed by our 'CanGym' medallions. The actual medallion is Gold in colour while the colour of the sticker represents progress being made.

RecreationalEach time a student receives an award (Step 1, Step 2, or Mastered) he/she has the opportunity to either:
a) advance within a color/level or 
b) move on to the next color/level. 

Within each level there are an average of 36 gymnastics skills that are distributed among the floor exercise, rings,vault, parallel and uneven bars, high bar, trampoline, pommel horse, and balance beam. These skills progress in their complexity as students master each successive medallion. Note: The school retains records on the progress of each student to assist in class placement in future sessions.

Daily Screening Checklist - Must be completed each day before entering the facility.

Gymnasts must come dressed and ready for classes/training. We ask that you only bring what is necessary to the gym.  We will have limited space for gymnasts to store their stuff daily and all personal items must be taken home each day.

Gymnastics for Parkour

parkour flipside 35363f8840d73379218dafd489143304Parkour (freerunning) has become a very popular activity these days. It is getting from point A, facing obstacles where you need to jump, climb, run, swing and flip to get to point B as quickly as possible. Flipside is responding to this demand by offering Gymnastics Foundations for Parkour. It is a safe, indoor environment where athletes can incorporate fitness into their lives and learn a series of skills they need in order to perfect the fancy acrobatic movements performed in Parkour (freerunning). Access to our tumble track which teaches jumps, twists and flips placing only their hands and feet on the track which leads directly into our 24 foot foam pit. This leaves them with practiced and correct body movements, body strength and balance all while having fun.

We will always try our very best to accommodate each registration as they are received. Please note that these classes will result in waitlists as they fill up. Early registration is suggested.

Here’s how it works
For every new, first time customer that you refer to us who registers in one of our programs, you will receive a $15 credit on your family account. There is no limit to the number of referrals you can make. Getting credit for your referral is quite easy. All you have to do is make sure that the referred customer provides us with your Last Name and Phone Number in the space provided for referrals at the time they register. Once their registration is processed, your family account will receive the credit to use towards future tuitions.

Terms and conditions
Credits will be awarded only for referrals of non-immediate family members. Credits are non-transferable and non-refundable, as they hold no cash value.

Insurance

insurance policy imageAccident Insurance 

All club members registered with Flipside Gymnastics receive coverage for accidents occurring during instruction classes. This includes participants, coaches, judges, facilitators and supporters.

Accident insurance only covers situations where an injury takes place because of an accident during the sanctioned gymnastic activity.

Flipside's accident insurance is secondary coverage only and does not provide primary accident insurance. It applies over and above coverage provided by government and private health insurance plans.

If a member does not have other primary accident insurance (ie. BC Medical Plan) then Flipside insurance policy coverage stated in this article does not apply.

Accident Policy Specifics

 For each separate accident, the policy may pay up to:

  • Accidental death & dismemberment limit: $15,000
  • Permanent total disability limit: $30,000
  • Accident reimbursement limit: $10,000 (costs not insured by the Provincial Medical Services Plan, including medical braces, emergency ambulance, excess physiotherapy, prescription drugs for the injury, etc)
  • Dental accident limit: $5,000
  • Fracture indemnity: From $50 to $500.
  • Physiotherapy limited to $30 per visit with a maximum of $300 per accident.
  • Treatment must be completed within 52-weeks from date of each accident

Limitations and Exclusions

No accident insurance benefit shall be payable for any loss resulting directly or indirectly, wholly or partially from any of the following causes:

  1. purchase, repair, or replacement of eyeglasses, contact lenses or prescriptions thereof (except as otherwise provided);
  2. sickness or disease either as a cause or effect;
  3. any intentionally self-inflicted injury;
  4. any benefits that are available under any Government Health Insurance Plan, whether enrolled in such a plan or non dental and/or other expense benefits shall be for the excess of expenses payable under any other benefit plan or policy;
  5. an insured person who is not a resident of any Canadian province that has enacted Medical Care Legislation unless stated specifically in this policy.

Additional Policy Information

  • Accident policy coverage applies only to appropriately club registered members (ie. casual, recreational, interclub, competitive, coach, judge etc.)
  • Accident policy coverage does not apply to birthday parties, one-time visitors, associate member programs, or other non-member activities.
    • One-time visitors (non-members) may be party participants or guest participants in a one-time event. One-time events might include workshops and special event days such as bring-a-friend day, gym promotional days, parent days, etc. 
    • Drop-in participants are NOT considered one-time (non-member) visitors due to the need for a prior readiness assessment. These participants should be registered, at a minimum, as casual members if they drop-in 5 or fewer times annually, or recreational members if they drop-in more than 5 times annually.

General Liability Insurancegeneral liability insurance

Flipside's general liability insurance policy is a broad type of insurance policy which provides liability insurance to Flipside for general business risks. General Liability claims are waived by all registered members at the time of Registration.

Ages less than 3.5 years, daycare must provide a teaching assistant for a 5:1 ratio.
